Child 7 year visa success story: ‘V’ entered the UK on Tier 2 (Intra-Company Transfer) visa in 2008 and was later joined by his family. V and his family approached City Legal as they were unable to secure further leave to remain, and their visa expiry was fast approaching.
City legal took detailed instructions on the matter and understood that V had two young children; one of them had spent seven years in the country. Even though children were young, they felt devastated about moving back to their home country as they had been studying in the UK made friends here.
They had rarely visited their home country, and when they did, they struggled to adapt to the cultural difference. V and his wife had already given up to the idea of remaining in the UK and had begun contacting schools back home so that the children’s education would not be interrupted, should they have had to move back to their home country.
When they approached City Legal, V and his wife did not know that they qualified to apply for further leave to remain under private life grounds. City Legal advised V and his wife that following an in-depth analysis of their case, it was clear that they will be eligible for being granted an extension of their leave to remain under the private life Child 7 years residency. City Legal provided detailed guidance on the eligibility and suitability criteria for making a Private Life application, emphasising the struggle that the children may encounter if forced to return to a country of which they barely knew the language and culture of.
You can only apply on the basis of your private life if you’re already living in the UK. You must be able to prove that you’re under 18 and you’ve lived in the UK continuously for at least 7 years, and it would be unreasonable to expect you to leave the UK.
Upon the expert advice of our Immigration lawyers, V and his wife agreed to proceed with the application. Our expert evidence and representations managed to prove to the Home Office that the children had fully adapted to a British lifestyle, and their removal would cause a significant impact on their education & psychological wellbeing. Within three months of submission, City Legal was happy to deliver the good news that the whole family were granted leave to remain in the UK.
